By using the services provided by Rocky Mountain Roll Off & Waste (“Company,” “we,” “us,” or “our”), including our website at rockymountainrolloffandwaste.com and all dumpster rental, waste hauling, and disposal services, you (“Customer,” “you,” or “your”) agree to be bound by the following Terms of Service. Please read them carefully before placing an order or using our services.

If you do not agree with any part of these terms, do not use our website or services.

Services Overview

Rocky Mountain Roll Off & Waste provides dumpster rental, roll-off container delivery, waste hauling, and related disposal services throughout the state of Colorado. Our services include, but are not limited to, residential cleanouts, commercial waste management, construction debris removal, demolition projects, industrial waste solutions, and event or emergency waste services.

All services are subject to availability, scheduling, and the specific terms outlined at the time of booking.

Service Area

We operate throughout Colorado, with our headquarters located at 155 W 62nd Ave, Denver, CO 80216. Availability of specific dumpster sizes and service types may vary by location. Delivery to remote or hard-to-access areas may be subject to additional fees or scheduling restrictions, which will be communicated before confirmation of your order.

Ordering and Scheduling

When you place an order through our website, by phone at (833) 652-9332, or via email at [email protected], you are requesting a service that is subject to our confirmation. An order is not considered final until we have confirmed it directly with you.

We make every reasonable effort to deliver and pick up dumpsters within the agreed-upon timeframe. However, delivery and pickup times are estimates and may be affected by weather, road conditions, equipment availability, or other circumstances beyond our control. We are not liable for delays caused by such factors.

Customer Responsibilities

As a customer, you agree to the following:

Placement and Access. You are responsible for ensuring that there is adequate space and access for the safe delivery, placement, and removal of the dumpster. The placement location must be on a flat, stable surface capable of supporting the weight of the container and its contents. You must ensure the delivery area is free of overhead obstructions, including low-hanging wires, tree branches, and awnings.

Permits. If the dumpster will be placed on a public street, sidewalk, right-of-way, or any other public property, you are responsible for obtaining all required permits from the relevant local authority before delivery. We are not responsible for fines, penalties, or citations resulting from a failure to secure proper permits.

Proper Use. You agree to use the dumpster solely for the disposal of materials that are accepted under our guidelines and in compliance with all applicable federal, state, and local laws and regulations. You must not load the container above the fill line or beyond the maximum weight capacity specified for the dumpster size you have rented.

Property Protection. Dumpster placement may cause surface damage to driveways, lawns, or other surfaces. We recommend placing protective materials (such as plywood boards) beneath the container. We are not responsible for surface damage resulting from the normal delivery, placement, or removal of the dumpster.

Prohibited Materials

You may not place the following materials in any dumpster rented from us:

  • Hazardous waste, including but not limited to chemicals, pesticides, solvents, oil-based paints, and industrial chemicals
  • Flammable or explosive materials, including gasoline, propane tanks, and fireworks
  • Asbestos and asbestos-containing materials
  • Medical or biohazardous waste
  • Batteries (automotive, lithium-ion, or lead-acid)
  • Tires (unless specifically authorized in writing)
  • Electronics and e-waste (unless specifically authorized)
  • Refrigerants and appliances containing Freon (refrigerators, air conditioning units)
  • Radioactive materials
  • Any other materials prohibited by federal, state, or local law

If prohibited materials are discovered in a dumpster, you will be responsible for all additional costs incurred, including removal fees, environmental remediation, fines imposed by regulatory agencies, and any related disposal charges. We reserve the right to refuse pickup of any container found to contain prohibited materials until those materials have been removed at your expense.

Pricing, Fees, and Payment

Quoted Pricing. Pricing for our services is based on the dumpster size, rental duration, type of waste, delivery location, and any other relevant factors communicated at the time of booking. The quote you receive represents the estimated cost based on the information you provide.

Additional Fees. You may incur additional charges under the following circumstances:

  • Exceeding the included weight allowance for your rental (overage charges will be assessed per ton or fraction thereof)
  • Extending the rental period beyond the agreed-upon term without prior arrangement
  • Requiring an additional trip due to a blocked or inaccessible dumpster at the time of scheduled pickup
  • Disposal of prohibited or special-handling materials found in the container
  • Dumpster damage beyond normal wear and tear

Payment Terms. Payment is due in accordance with the terms established at the time of booking. We accept major credit cards and other payment methods as indicated during checkout or as arranged by phone. Failure to pay within the agreed-upon timeframe may result in late fees, suspension of services, or referral to collections.

Rental Period and Extensions

Each rental includes a specified rental period communicated at the time of booking. If you need the dumpster for a longer period, you must contact us before the rental period expires to arrange an extension. Extensions are subject to availability and will incur additional daily or weekly charges.

If the dumpster is not made available for pickup at the end of the rental period and no extension has been arranged, additional rental fees will continue to accrue until the container is retrieved.

Weight Limits and Overloading

Each dumpster has a maximum weight capacity that will be communicated at the time of booking. You are responsible for ensuring that the total weight of the contents does not exceed this limit. Overloaded containers pose safety hazards during transport and may violate road weight regulations.

If a container exceeds the weight limit, we reserve the right to require you to remove materials before transport, or we may transport the container and charge overage fees based on the actual weight recorded at the disposal facility.

Damage to Equipment

You are responsible for any damage to our dumpsters or equipment that occurs while the container is in your possession, beyond normal wear and tear. This includes damage caused by overloading, misuse, unauthorized modifications, contamination with prohibited materials, or negligence.

Repair or replacement costs for damaged equipment will be billed to you.

Cancellations and Refunds

If you need to cancel a scheduled delivery, please notify us as soon as possible. Cancellations made at least 24 hours before the scheduled delivery time will receive a full refund of any prepaid amounts. Cancellations made less than 24 hours before delivery may be subject to a cancellation fee.

Once a dumpster has been delivered, no refunds will be issued for unused rental time unless we are unable to fulfill our service obligations due to circumstances within our control.

Limitation of Liability

To the fullest extent permitted by Colorado law, Rocky Mountain Roll Off & Waste shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to our services, including but not limited to property damage, project delays, lost profits, or environmental contamination caused by materials you placed in the dumpster.

Our total liability for any claim arising from our services shall not exceed the total amount you paid for the specific service giving rise to the claim.

Nothing in these terms limits our liability for bodily injury or death caused by our negligence, or for any other liability that cannot be excluded under applicable law.

Indemnification

You agree to indemnify, defend, and hold harmless Rocky Mountain Roll Off & Waste, its owners, employees, agents, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney’s fees) arising from your use of our services, your breach of these terms, your violation of any law or regulation, or any claim that materials you placed in the dumpster caused harm to persons, property, or the environment.

Force Majeure

We shall not be held liable for any failure or delay in performing our obligations under these terms if such failure or delay results from events beyond our reasonable control. This includes, but is not limited to, severe weather, natural disasters, road closures, government orders, labor disputes, equipment failure, pandemics, or disruptions to waste disposal facilities.

In such events, we will make reasonable efforts to resume services as soon as practicable and will communicate any expected delays to you.

Website Use

Our website at rockymountainrolloffandwaste.com is provided for informational purposes and to facilitate the ordering of our services. You agree not to use the website for any unlawful purpose, to attempt to interfere with its operation, or to access any data or systems not intended for your use.

All content on our website, including text, images, logos, and design elements, is the property of Rocky Mountain Roll Off & Waste and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content from our website without our prior written consent.

Privacy

Your use of our services and website is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using our services, you consent to the practices described in that policy.

Dispute Resolution

Any disputes arising out of or relating to these terms or our services shall first be addressed through good-faith negotiation between you and Rocky Mountain Roll Off & Waste. If a resolution cannot be reached through negotiation, the dispute shall be resolved through binding arbitration conducted in Denver, Colorado, in accordance with the rules of the American Arbitration Association. The decision of the arbitrator shall be final and binding.

This agreement shall be governed by and interpreted in accordance with the laws of the state of Colorado, without regard to its conflict-of-law provisions.

Modifications to These Terms

We reserve the right to update or modify these Terms of Service at any time. Changes will be posted on our website, and your continued use of our services after any changes are posted constitutes your acceptance of the revised terms.

Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

Entire Agreement

These Terms of Service, together with any service agreements, quotes, or invoices provided at the time of booking, constitute the entire agreement between you and Rocky Mountain Roll Off & Waste regarding the subject matter herein. They supersede all prior communications, representations, and agreements, whether written or oral.
